Terms of Service

1. The agreement

Wellora (the website at wellora.ink and the Wellora iOS app, together the "Service") is operated by its individual developer, a private person based in Ukraine ("we", "us"). By creating an account or using the Service you agree to these Terms and to our Privacy Policy (wellora.ink/privacy). If you do not agree, please do not use the Service.

2. Who can use Wellora

You must be at least 13 years old. If you are under 18, or under the age of majority where you live, you confirm that a parent or guardian has agreed to these Terms on your behalf and will supervise your use. You must give accurate information when you sign up and keep your sign-in details secure; you are responsible for activity on your account.

3. Health notice: not medical advice

Wellora is a general wellness and self-tracking tool. It is not a medical device and does not diagnose, treat, cure or prevent any disease. BMI, calorie and pace calculations, ideal-weight ranges, workout suggestions and all AI-generated content are general information based on standard formulas and on what you enter. They can be inaccurate or not suited to you.

• Talk to a doctor or a qualified professional before starting a diet or exercise programme, and before making significant changes, especially if you are pregnant or breastfeeding, under 18, have a medical condition, or take medication.
• Do not ignore professional medical advice or delay seeking it because of something in Wellora.
• If you have, or think you may have, an eating disorder, Wellora is not the right tool; please seek support from a health professional.
• Stop exercising and seek help if you feel pain, dizziness or shortness of breath.
• In an emergency, call your local emergency number.

4. AI features

Some features use artificial intelligence to analyse your entries, estimate calories or suggest workouts. AI output is generated automatically, can be wrong, incomplete or out of date, and is not reviewed by a person before you see it. Check important information yourself. AI features may be limited to a number of uses per week, and we may change those limits, the models behind them, or turn features off.

5. Acceptable use

You agree not to:

• break any law or anyone's rights while using the Service;
• post content that is abusive, harassing, hateful, sexually explicit, or that promotes self-harm or dangerous weight loss, in your profile, status, bio, competition names or messages;
• impersonate someone else or create accounts to abuse referrals, rewards, competitions or AI limits;
• access other users' data, probe or attack the Service, or bypass its security or limits;
• scrape, copy or resell the Service or its content, or use automated means to access it except through its normal interface;
• use the Service to send spam or advertising to other users.

6. Your content

You own what you put into Wellora: your logs, notes, profile text and feedback. You give us a non-exclusive, worldwide, royalty-free licence to store, process and display that content only as needed to run the Service for you, including showing the parts you choose to share to other users. The licence ends when you delete the content or your account, except for copies other users already received (for example competition results) and backups kept for a limited period. We may remove content that breaks these Terms.

If you send us suggestions or feedback about the Service, we may use them without any obligation to you.

7. Friends, profiles and competitions

Social features are optional. What others can see depends on the settings you choose, as described in the Privacy Policy. Competitions are friendly challenges for motivation only; they have no prizes of monetary value, and results depend on data participants enter themselves, which we do not verify. Please be kind: behind every profile is someone working on their health.

8. Points, cards and other virtual items

Wellora awards points, streaks, achievements, reward cards, card packs, dust and profile themes ("virtual items") for using the app. Virtual items cannot be bought with real money, have no monetary value, cannot be exchanged for money or anything outside the Service, and cannot be sold or transferred. You receive a limited, personal licence to use them within the Service; you do not own them. Pack contents are random according to drop chances shown in the shop. We may change how virtual items are earned or what they do, correct balances affected by errors or abuse, and reset them if needed to keep the system fair. They end when your account is closed.

9. Changes and availability

The Service is currently provided free of charge. We are continually improving it, so features may be added, changed or removed. We try to keep Wellora available and your data safe, but we do not guarantee that the Service will be uninterrupted or error-free, and we may suspend it for maintenance. If we ever introduce paid features, they will be clearly marked and will not be charged without your agreement.

10. Ending your account

You can stop using Wellora at any time and ask us to delete your account at support@wellora.ink. We may suspend or close an account that seriously or repeatedly breaks these Terms, puts other users or the Service at risk, or where the law requires it. Where reasonable, we will tell you why and give you a chance to respond. We may also discontinue the Service; if we do, we will give reasonable notice where possible.

11. Our intellectual property

The Service, including its design, software, the Wellora name and logo, card artwork and other content we provide, belongs to us or our licensors and is protected by law. These Terms give you a personal, non-exclusive, non-transferable right to use the Service for your own non-commercial purposes; they do not give you any other rights to it.

12. Third-party services

Signing in with Google or Apple, and using Wellora on the web or through the App Store, is also subject to those companies' own terms. When you download the iOS app from the App Store, Apple is not responsible for the app or its support, and Apple's standard end-user licence terms apply alongside these Terms.

13. Disclaimers and limitation of liability

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we make no warranties about the accuracy of calculations, estimates or AI output, or about the Service meeting your needs.

To the fullest extent permitted by law, we are not liable for indirect, incidental or consequential losses, for loss of data or virtual items, or for any health outcome resulting from decisions you make based on the Service. Because the Service is free, our total liability to you for any claim is limited to 100 US dollars or the equivalent in hryvnias.

Nothing in these Terms limits liability that cannot be limited by law, such as liability for death or personal injury caused by negligence or for fraud, and nothing affects the mandatory rights you have as a consumer under the law of the country where you live.

14. Governing law and disputes

These Terms are governed by the law of Ukraine. If you have a problem, please contact us first at support@wellora.ink; most issues can be solved quickly. Disputes that cannot be resolved this way will be decided by the competent courts of Ukraine. If you are a consumer living in another country, you also keep the protection of the mandatory laws of that country and may bring a claim in its courts.

15. Changes to these Terms

We may update these Terms as the Service evolves. The date at the top shows the latest version. If a change is material, we will tell you in the app or by email before it takes effect; continuing to use the Service after that means you accept the new Terms. If you do not agree, you can close your account.

16. General

If any part of these Terms is found unenforceable, the rest remains in effect. Not enforcing a provision is not a waiver of it. You may not transfer your rights under these Terms; we may transfer ours to a successor who takes over the Service. These Terms, together with the Privacy Policy, are the whole agreement between us about the Service. If the English and Ukrainian versions differ, the version in the language you use the Service in applies to you.
